Trade secrets: EP sets legal framework to make freedom of expression and protection of corporate interests compatible

"In the face of the spiralling numbers of the theft of trade secrets, Europe cannot remain silent or inert. Today, we have paved the way for a common European legal basis in order to fight against industrial espionage and protect innovation while safeguarding fundamental freedoms, especially the freedom of expression and information", said Constance Le Grip MEP, Rapporteur on the protection of trade secrets which was adopted today by a large majority (19+, 2-, 3 abstentions) in the Legal Affairs Committee of the European Parliament.

"The guarantees provided by the European Parliament for journalists’ work and to protect their sources are real and unambiguous", said Le Grip. "We clearly stipulate that journalists will be exempt from the application of the measures in the Directive as part of their professional activity, even if they have been led to detain and illegally disclose a trade secret during an investigation. Similarly, sources will have the opportunity to benefit from this exemption even if they reveal a malfunction or an illegal activity for example, in order to defend the public interest."

"I would like to thank the Rapporteurs from the other political groups with whom we have kept open and frank contact throughout our negotiations. It is thanks to this constructive spirit and consensus-building that we have managed to significantly improve the Commission's proposal and obtain a balanced text which preserves the interests of business while protecting journalists and whistleblowers," concluded Le Grip.
